The Clean Water Act created the National Pollution Discharge Elimination System ("NPDES"), under which permits may be issued for discharge of pollutants from point sources into the waters of the United States. Under the Act, a state may apply to the Environmental Protection Agency for authority to issue the required permits within the state.
